Terms of Service

Last updated · October 2, 2026

Welcome to ROOST Creative Club & Residency ("ROOST," "we," "us," or "our"). By accessing our website at www.roostccr.com, submitting a membership application, joining our RSVP or waitlist, or paying any fee, you agree to these Terms of Service. If you do not agree, do not use the site or apply for membership.

1. ROOST Is Not Yet Fully Live

ROOST is currently in a pre-launch phase. The digital member platform, marketplace, collaboration room, member directory, events, and the future physical clubhouse in Metro Detroit are under active development and may not be fully available. Features, benefits, partners, and experiences described on this site represent our planned offering and may change, be delayed, or never launch. Nothing on this site is a guarantee that any specific product, feature, event, or facility will be delivered.

2. Membership Is Vetted & Not Guaranteed

ROOST membership is by application and is intentionally curated. Submitting an application or paying any application fee does not guarantee approval, membership, or access to any benefit. We may approve, defer, or decline any application in our sole discretion, without obligation to provide a reason.

3. Application Fees & Payments

  • Any application fee (including but not limited to Resident and Access application fees) is non-refundable, regardless of whether your application is approved, declined, or withdrawn.
  • Application fees cover the administrative cost of reviewing your application and are not a deposit toward membership dues.
  • Approved applicants may be invited to schedule a call with a ROOST representative before selecting a membership plan. Membership plans and pricing may vary and are subject to change.
  • Any membership dues, deposits, or payments collected before full launch are accepted on the terms described in these Terms and the applicable plan description.

4. No-Refund Policy

All fees, dues, and payments are non-refundable. This includes application fees, membership dues, deposits, RSVP or waitlist fees, event payments, and any other amounts paid to ROOST. No refunds will be issued if ROOST does not launch, if features are delayed or cancelled, if your application is not approved, if you cancel your membership, or for any other reason except where required by applicable law.

If a chargeback or payment dispute is initiated, you remain responsible for the original amount and any related costs we incur in responding to the dispute.

5. Pre-Launch & Deposit Risk Acknowledgment

You acknowledge and agree that ROOST is a developing business. If you pay any deposit, dues, or other amount before ROOST is fully operational, you do so understanding that:

  • The platform, clubhouse, events, or experiences may be delayed or may not launch.
  • Partners, venues, and benefits may change or become unavailable.
  • ROOST may pause, restructure, or cease development at any time without delivering the full planned offering.
  • You are not entitled to a refund of any fee or payment under these circumstances, and ROOST is not liable for any loss arising from a delayed or non-launching product.

6. No Warranty

The site and all ROOST services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, secure, or that any feature will launch or perform as described.

7. Limitation of Liability

To the fullest extent permitted by law, ROOST, its owners, members, employees, partners, and affiliates are not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the site, your application, your membership, any payment, or the non-launch or delay of any feature. Your sole remedy for any payment-related dispute is limited to what is expressly stated in these Terms and excludes any refund except where required by law.

8. Indemnification

You agree to indemnify and hold ROOST harmless from any claim, damage, or expense arising from your use of the site, your application, your conduct toward other members or partners, or your breach of these Terms.

9. Member Conduct

Approved members must provide accurate information, maintain the confidentiality of any login, and conduct themselves respectfully. We may suspend or terminate access for misconduct, misrepresentation, or violation of these Terms, with no refund.

10. Changes to These Terms

We may update these Terms at any time. Continued use of the site or membership after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any dispute will be resolved in the courts located in or near Metro Detroit, Michigan.
